Early Tree provides software solutions for the early years education sector, including but not limited to:

• Early Tree Nursery Management System - a nursery operating system for managing children, staff, attendance, observations, and compliance
• Inspector Who - an Ofsted inspection intelligence and analytics platform
• Early Years Funding Portal - a portal for early years funding claims and administration

The specific features and functionality available to you may depend on your subscription plan and any additional agreements you have with Early Tree.

3. User Accounts

To access certain features of our Services, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

You must provide accurate and complete information when creating an account, and keep this information up to date. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

You retain ownership of any content you submit through our Services. By submitting content, you grant Early Tree a non-exclusive, worldwide, royalty-free licence to use, store, and process that content as necessary to provide the Services to you.

For Inspector Who specifically: The data and analytics provided are derived from publicly available Ofsted inspection reports. We do not guarantee the accuracy, completeness, or timeliness of this data. The insights provided are not official Ofsted statistics and should not be relied upon as such.

8. Limitation of Liability

To the maximum extent permitted by law, Early Tree shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services
• Any unauthorised access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

9. Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Services will immediately cease. We will make reasonable efforts to allow you to export your data before termination, subject to applicable laws and our data retention policies.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
